He advised that the first step is to carefully read the rent agreement, which clearly specifies the timeline for returning the security deposit and the rules regarding deductions.

You should attempt to discuss the matter amicably with the landlord. If they still fail to return the deposit, you can send a formal legal notice demanding the refund within a specified timeframe.

If the Model Tenancy Act or local rent control laws are in force in your state, you can file a complaint with the Rent Tribunal or Rent Controller. Additionally, you can approach the consumer court or a civil court to address the grievance.

How many months' rent can a landlord demand as a security deposit?
Advocate Varun Dixit stated that under the Model Tenancy Act, 2021, a landlord can demand a maximum of two months' rent as a security deposit or advance for residential property. For commercial property, this limit is set at a maximum of six months' rent.
