However, when installed in or outside a home, they can sometimes become a nuisance for neighbors. Some people may welcome this, while others may not. This is because if a camera is installed outside someone's home, their neighbor is almost certain to be captured on camera as well. In such instances, this is considered a violation of the neighbor's privacy. Let's explore what the regulations regarding the installation of CCTV cameras at home actually state.

Rules for Installing CCTV Cameras at Home

While there are no specific, rigid regulations governing the installation of CCTV cameras in private homes, the person installing the camera possesses the right to security. Conversely, the neighbor residing nearby possesses the right to privacy. Consequently, neither party is permitted to infringe upon the rights of the other. The individual installing the CCTV camera must ensure that they are not violating the privacy of the person across from them. The camera should be installed solely for security purposes, not for the purpose of prying into someone else's home.

What Does the Law Say?

The law, too, takes a similar stance on this matter: if a camera installed at one person's home records the private moments or internal activities occurring within another person's home, it is deemed improper. Such an act constitutes a violation of an individual's privacy. In such situations, the law advises that one should first engage in a dialogue with the neighbor; if they raise no objections, you may proceed with the installation of the camera. However, another facet of this issue is that even if a neighbor is troubled by the camera, they cannot simply file a complaint to compel its removal.

A Case from Kochi Comes to Light

It is worth noting that in November 2025, a similar case regarding this issue came to light in Kochi. In a case involving a dispute over a CCTV camera between two neighbors, the matter escalated to the courts, where one neighbor demanded the removal of the device. However, after hearing the arguments of the opposing party, the court concluded that just as no individual can be permitted to compromise another's safety, neither can a person be allowed to infringe upon another's privacy through the use of a CCTV camera. Consequently, the court delivered a verdict in this matter that upheld the interests of both parties.
