Tech Tips: How to detect spy apps installed on your phone, know here...

In a recent divorce case, the Madhya Pradesh High Court ruled that a wife’s private WhatsApp chats can be produced as evidence under Section 14 of the Family Courts Act, 1984, even if these were obtained without her permission. In this case, the husband accessed his wife’s private WhatsApp chats by installing a certain app (possibly a spy app) on her phone and found that she was having an extramarital affair. The husband’s lawyers decided to produce this as evidence in court and seek divorce on the grounds of cruelty and adultery.
The wife’s lawyers challenged this move and opposed producing her WhatsApp chats in court, arguing that the husband’s action violated her right to privacy under Article 21 of the Indian Constitution and Sections 43, 66 and 72 of the Information Technology Act. The Madhya Pradesh High Court rejected this argument and said that even though the right to privacy is recognized as a fundamental right, it is not absolute and has exceptions and limitations.
