How to Respond to an Income Tax Notice: Have you received a tax notice? Learn the significance of Sections 143(1) through 245, along with an easy method to submit your response via 'e-proceedings' from home, ensuring a hassle-free experience.
How to Respond to an Income Tax Notice: People often get anxious at the mere mention of "Income Tax," and if a tax notice actually arrives at their doorstep, their panic intensifies. However, did you know that not every notice spells trouble? In reality, most of these notices are merely sent to request minor details or to verify information you have previously submitted. If you respond promptly and correctly, the matter can be resolved with ease.
Is Your Notice Genuine?
First and foremost, ensure that the notice you have received is not fraudulent. Nowadays, scammers frequently send fake notices to intimidate people. You can verify the authenticity of the notice by visiting the Income Tax Department's e-Filing Portal. To do this, you will need your PAN card, your registered mobile number, and the DIN (Document Identification Number) printed on the notice. If the details of the notice are not found on the portal, you can safely assume it is fake.
What Is the Notice About?
Upon receiving a notice, the first thing you should do is read the specific 'Section' mentioned within it. This indicates exactly what the department requires from you:
Section 143(1): This serves merely as an intimation confirming that your tax return has been processed.
Section 142(1): The department is requesting additional information from you prior to the assessment process.
Section 143(2): This is a scrutiny notice, indicating that your tax file will undergo a detailed and thorough examination.
Section 148: This notice is issued for re-assessment if the department suspects that certain portions of your income have escaped taxation.
Section 245: This intimation is issued if there are outstanding tax arrears from a previous period that are to be adjusted (deducted) against your current tax refund.
What is the Correct Way to Respond?
You do not need to visit any government office in person to respond to a notice. The entire process can be completed online:
Log in to the Income Tax e-filing portal.
Navigate to the ‘Pending Actions’ tab and click on ‘e-Proceedings’.
You will find your notice listed there; click on it to upload your response along with the necessary documents.
After submitting your response, do not forget to download the Acknowledgement copy; this will serve as your proof of submission.
What Happens if You Delay?
Any delay or negligence in communicating with the Tax Department can prove to be costly for you. If you fail to respond on time or provide incomplete information, you may face heavy penalties. Should the matter escalate, the Department may even initiate a rigorous audit of your records. Therefore, always keep your bank statements, Form 16, and investment proofs ready. If the matter appears complex, do not hesitate to seek advice from a Chartered Accountant (CA). Providing accurate information and taking timely action constitute the most effective solution to this problem.
