**When will the new rules come into effect?**
These new RBI rules will come into force on January 1, 2027. For the first time, the digital recovery process associated with devices purchased on finance—such as mobile phones, laptops, and tablets—has also been brought under the regulatory framework. This means banks and finance companies must comply with the prescribed rules in these cases as well.
**When can recovery agents call?**
Under the new rules, banks or recovery agents will generally only be permitted to contact customers between 8:00 AM and 7:00 PM. Any communication outside these hours will require the customer's prior consent or request. Consequently, customers can no longer be harassed by calls made late at night or very early in the morning.
**When are agents prohibited from harassing customers?**
The RBI has explicitly stated that recovery agents must not contact individuals for loan recovery during times of bereavement, medical emergencies, or significant family occasions like weddings. Harassing customers during such times is strictly prohibited.
**Complete ban on threats**
According to the new RBI rules, recovery agents cannot speak to customers in a threatening manner during loan recovery. Abusive language, intimidation, harassment through repeated calls, or threats concerning a borrower's family, property, or reputation are strictly prohibited.
**No public shaming on social media**
Banks or recovery agents are prohibited from defaming customers by sharing their photos, videos, audio recordings, or personal information on social media. Misusing a person's personal information for loan recovery will also be prohibited under the new rules.
