News on Compensation for Train Delays: The Jharkhand Consumer Commission has delivered a significant verdict in favor of a rail passenger who suffered mental and financial distress due to an excessive train delay. In September 2024, the passenger had booked two sleeper-class tickets on the Ispat Express from Tatanagar (Jharkhand) to Sambalpur; however, the train arrived in Sambalpur with a delay of 8 hours and 48 minutes beyond its scheduled time.

Following the physical, mental, and financial losses caused by this delay, the passenger sent a legal notice to the Railways and subsequently approached the Consumer Forum. While the Railways argued that the matter fell solely under the jurisdiction of the Railway Claims Tribunal (RCT), the Consumer Commission—led by President Sunil Kumar Singh and other members—rejected this plea and ruled that the case constituted a "deficiency in service" by the Railways. The Commission ordered the Railways to deposit a total of ₹35,000 within 45 days, comprising ₹30,000 in compensation and ₹5,000 towards litigation costs.

Passenger Rights Regarding Train Delays
Under the Railway Refund Rules of 2015, passengers are entitled to specific facilities and rights if a train is delayed by three hours or more from its originating or departure station. If a train is running three hours or more late and a passenger wishes to cancel their journey, they are entitled to a full fare refund without any cancellation charges. 

Additionally, if a passenger misses a subsequent connecting train due to the delay of the first train, they receive a full refund for the missed leg of the journey; however, this is conditional upon the "connecting journey" option having been selected on IRCTC at the time of booking. Meanwhile, for premium trains like Shatabdi, Rajdhani, and Duronto, the Railways provides free tea, snacks/meals, and water to passengers if the train is delayed by more than two hours. For trains operated by IRCTC, such as the Tejas Express, compensation is provided via insurance claims: ₹100 for delays exceeding one hour and ₹250 for delays exceeding two hours.

How to File for a Refund and TDR
Refund amounts are not automatically transferred to your account; you must file a TDR (Ticket Deposit Receipt) within the prescribed time limit to claim it.

How to File a TDR for Online E-tickets
Log in to the IRCTC website or official mobile app. Go to the 'My Bookings' section and select the relevant ticket. Click on the 'File TDR' option. From the dropdown menu, select the reason—such as "Train running more than three hours late and passenger did not travel"—and submit the request. Note that the TDR must be filed before the train's scheduled departure time.

How to File a TDR for Counter Tickets
If you purchased a paper ticket from a station counter, visit the ticket counter and surrender the ticket before the train's scheduled departure time. You will receive an immediate cash refund.

How to Obtain Compensation via the Consumer Forum
If you miss a flight, miss a job interview, or suffer significant financial loss due to a severe train delay (e.g., 6 to 12 hours), you can approach the Consumer Forum for compensation. However, you must follow the steps outlined below.

Keep an official record of the delay (such as a screenshot from the National Train Enquiry System or NTES) and retain bills or tickets related to your loss. You can call 1915 or contact the state-level consumer helpline. You can also file a compensation claim against the Railways from the comfort of your home via the Ministry of Consumer Affairs' online 'e-Daakhil' portal.
