When it comes to online food services, almost everyone orders food from outside these days; however, it often happens that the food delivered turns out to be of poor quality or spoiled. In such situations, there is no need to panic, as Indian laws grant you the full right to file a complaint and seek compensation.
Where Should You File a Complaint?
If the food you receive is spoiled, your first step should be to file a complaint within the 'Help' or 'Support' section of the specific app you used to place the order—such as Zomato or Swiggy. You should upload photographs of the spoiled food within the app. Doing so can help you receive a quick refund or credit.
Alternatively, if the food poses a health risk, you can register a complaint through the FSSAI's 'Food Safety Connect' portal or by calling their toll-free helpline number.
Additionally, you can file a complaint with the National Consumer Helpline (NCH) by dialing 1915 or by using the UMANG app.
Most importantly, if the matter is severe—for instance, if it involves food poisoning—you can file a case in the Consumer Court through the 'e-Daakhil' portal.
What Are the Key Regulations?
Under the Consumer Protection Act, 2019, e-commerce companies are mandated to acknowledge a complaint within 48 hours and provide a resolution to the issue within one month.
It is crucial to ensure that whenever you file a complaint, you have the following documents/evidence ready: your Order ID, the bill/invoice, and photographs or videos of the spoiled food. Furthermore, if you have fallen ill after consuming the food, a medical report from a doctor will also serve as valuable evidence in such cases.
Finally, keep in mind that in such matters, both the restaurant and the delivery platform may be held jointly responsible.
How to Obtain Compensation?
If you have received substandard food, you can demand a full refund. Furthermore, if your health deteriorates as a result of the food, the Consumer Court can award you compensation covering both medical expenses and the mental distress caused.
