Promotion and Regulation of Online Gaming Rules, 2026
The Ministry of Electronics and Information Technology (MeitY) has framed a new set of regulations concerning online gaming, titled the 'Promotion and Regulation of Online Gaming Rules, 2026.' These rules outline the mechanism for implementing the legislation passed by Parliament in August 2025. Before formulating these regulations, the government consulted with various ministries and conducted a thorough legal review to ensure the establishment of clear and transparent guidelines for the rapidly expanding online gaming sector. Specifically, these rules address growing public concerns regarding games involving monetary stakes and the potential for addiction associated with them.

Establishment of a New Authority
Under this new framework, a new entity named the 'Online Gaming Authority of India' will be established to oversee and regulate online gaming activities. This authority will be headquartered in New Delhi and will function under the aegis of MeitY. Its composition will include representatives from the Ministry of Home Affairs, the Ministry of Finance, the Ministry of Information and Broadcasting, the Ministry of Youth Affairs and Sports, and the Ministry of Law. The Authority will be responsible for maintaining a list of online 'money games,' enforcing regulations, and collaborating with banks and law enforcement agencies to curb illicit financial transactions.

Distinction Between Money Games and Esports
The new regulations also lay down the procedure for determining whether a specific game qualifies as a 'money game' or as a standard game/esports. This determination will be made by the Authority based on applications submitted by gaming companies or through official government notifications. This process will determine whether money is being staked in the game, whether monetary rewards are received upon winning, and whether the game's prizes can be converted into cash. This procedure must be completed within 90 days to ensure that companies receive timely clarity.
