In some cases, security deposits are demanded for 5-6 months, while in others, rent is increased without notice. But this will no longer be the case. Landlords will no longer be able to demand security deposits at their own discretion. The government has made this arrangement.

Security deposits will be regulated against arbitrary amounts.

Many landlords in the country currently charge arbitrary amounts as security deposits. To prevent this, the government is pushing for the nationwide implementation of the Model Tenancy Act. The new Rent Rules 2025 clearly state that security deposits will be capped. Rents will not be arbitrarily increased, and no one will be evicted without reason. This change brings significant relief to tenants.

Under the new rules, a maximum of two months' rent can be placed as security for residential properties. For commercial spaces like shops and offices, this limit has been set at six months. This will reduce the pressure on tenants to suddenly deposit large sums and make renting a home easier. People often hold back on rent due to security.

Rent will not be paid without a written agreement.

Following the Model Tenancy Act, a written rent agreement has now become mandatory. It will clearly state the rent, its escalation, repair responsibilities, notice period, and rental period. It will be mandatory to submit the agreement to the Rent Authority within 60 days of its completion.

In addition, states will be required to create an online platform where rent agreements will be digitally registered. This record will be legally valid and will serve as the key evidence in any dispute. This will provide transparency to both tenants and landlords, preventing either party from changing the terms at will.
