Illegal construction occurring in front of or near your home not only creates traffic and safety issues but also infringes upon your property rights. It also poses future problems for the community. Often, lodging a complaint against such illegal construction can lead to various hassles. However, if you wish to file a complaint without revealing your identity (confidentially), a Supreme Court advocate has outlined several options based on legal provisions.
Supreme Court advocate Adidev Kumar explained that if unauthorized construction is taking place in front of your home, you should first secure evidence—such as photos or videos and, if possible, a copy of the approved building plan obtained via RTI. This is crucial because the law mandates that a notice be served before any further action is taken regarding the property.
**File a Complaint with the Municipal Corporation or Development Authority**
Advocate Adidev stated that the primary responsibility for taking action against illegal construction lies with the local municipal corporation or development authority. You should submit a written complaint to the municipal council chairperson, municipal corporation, or development authority, providing details such as the property/Khasra number and the nature of the violation. Relevant laws empower these authorities to halt construction or issue demolition notices in cases where approved plans or building regulations are violated.
If you wish to keep your identity confidential, you can use the municipal corporation's portal or mobile app to file a complaint. Additionally, you can utilize online grievance portals such as the e-Nagarpalika portal, the state public grievance redressal system, or the CM Helpline app. These platforms generate a tracking number and create a documentary record; based on such complaints and subsequent notices, municipal teams in many cities have successfully demolished illegal structures. Adidev stated that if the issue involves land encroachment, obstruction of a path, or an immediate safety risk, one should report it to the police station citing provisions related to public nuisance, mischief, or encroachment under Sections 126, 270, 285, and 324 of the BNS (Bharatiya Nyaya Sanhita/formerly IPC); this approach has successfully led to the temporary halting of construction work in many instances.
You can call Dial 112 to report that an illegal construction is obstructing a public path or disturbing the peace. You may also request the police to keep your identity confidential.
What to do in case of illegal construction or encroachment on government land
If the construction is taking place on government or *Nazul* land, a road, a drain, or a park—or if the municipal body fails to respond—submit an application to the District Magistrate (DM) or Tehsildar. These revenue officers control land records and have the authority to order the removal of encroachments from government land. If the local body fails to take action despite repeated complaints, a writ petition for *Mandamus* can be filed in the High Court under Article 226 of the Constitution, impleading the concerned officials, the state government, and the builder as parties.
In its *suo motu* proceedings regarding illegal construction and land-use violations, the Supreme Court (specifically the bench comprising Justice Ahsanuddin Amanullah and Justice R. Mahadevan, which has been monitoring this matter since March 2026) has directed development authorities to go beyond mere surveys. They have been instructed to submit details of concrete actions taken against violators—such as sealing or demolition—through affidavits verified by senior officials. Therefore, it is crucial to preserve documentary evidence at every stage, such as RTI responses, complaint acknowledgment numbers, and notices, as a systematic and well-documented chain of complaints ensures prompt and serious action from authorities and courts.
