ITR Filing 2026: Taxpayers may face penalties for delays or errors in filing their Income Tax Return (ITR). Let us understand which sections apply to specific lapses and the corresponding penalty amounts.

ITR Penalty Rules: If you have not yet filed your Income Tax Return (ITR) or have made a mistake while submitting it, even a minor oversight could lead to a penalty of thousands of rupees. Penalties are imposed under various provisions for different types of lapses.

Therefore, it is crucial to verify all details thoroughly before filing your ITR and to submit the return within the stipulated deadline to avoid any complications. Let us look at the penalties applicable under specific sections for various errors.

Late fee for filing ITR after the deadline

Section 234F of the Income Tax Act applies if the ITR is filed after the deadline of July 31, 2026. In this scenario, if your total income exceeds ₹5 lakh, you may have to pay a late fee of up to ₹5,000. However, if your total income is ₹5 lakh or less, the maximum late fee applicable is ₹1,000.

Hefty penalties for incorrect information and violation of tax rules

A penalty ranging from ₹1,000 to ₹5,000 may be imposed under Section 234-I for filing a revised ITR late.
Under Section 270A, a penalty of up to 50% of the outstanding tax liability may be imposed for under-reporting income.
In cases involving incorrect or false information, this penalty can increase to up to 200% of the outstanding tax liability. Accepting cash of ₹2 lakh or more in a single day or in a single transaction—in violation of the rules—can attract a penalty equal to the entire amount received, under Sections 269ST and 271DA.

What happens if self-assessment tax is not paid?

Failure to pay self-assessment tax on time can lead to action under Sections 140A and 221. You may be liable for an additional penalty of up to the amount of the outstanding tax.

File your ITR before the deadline.
Provide accurate details regarding all sources of income.
