In India, gratuity rules are established under the Payment of Gratuity Act, 1972. This rule applies to companies with at least 10 employees. Generally, the gratuity amount is determined based on the employee's last basic salary and dearness allowance (DA). Currently, the maximum limit for gratuity is set at ₹20 lakh.

When is gratuity awarded?
Gratuity is awarded when an employee serves the same company continuously for a certain period. Generally, an employee must have worked for the company for at least 5 years to receive gratuity. However, in certain cases, such as the employee's death or permanent disability, this condition does not apply.

Under what circumstances can gratuity be stopped?
Now, people think that gratuity is guaranteed upon leaving the job, but the company can withhold it under certain circumstances. For example:

Damaging company property
If an employee is fired for damaging company property, willful negligence, or causing financial loss to the company, the company can withhold the gratuity amount. In such cases, the amount of the loss can be deducted from the gratuity.

Violent behavior
If an employee quarrels at the workplace, behaves violently, or engages in serious indiscipline, the company can also confiscate their gratuity.

Fraud
In addition to these, if an employee is found guilty of serious offenses such as fraud, forgery, or falsifying records and is terminated for this reason, their gratuity can also be withheld.

Keep these things in mind:
Gratuity can only be withheld if the employee is terminated for these serious reasons. If the employee voluntarily leaves the job, the company generally cannot withhold gratuity.

Furthermore, withholding gratuity for a long period of time due to a pending investigation is also considered against the rules.
