Often, when we change jobs or consider leaving, the first question that comes to mind is, "Will I receive gratuity?" The current rules have disappointed millions of employees. The reason was the strict five-year requirement, which was beyond everyone's reach in today's dynamic job market. However, the tide has turned. The new labor code has transformed the old system. Now, the long wait of five years can end, and you can become eligible for gratuity even after just one year of service. The question then becomes: if your basic salary is ₹30,000, how much will you receive after one year?

A major relief for employees
Under the old rules, it was mandatory to work for five consecutive years with the same company to receive gratuity. This rule often led to young people in the private sector, who frequently changed jobs for better opportunities, losing a significant portion of their savings. But the proposals of the New Wage Code have changed the entire picture.

Under the new provisions, the time limit for gratuity eligibility has been reduced to one year. This means that if you have worked continuously for one year in an organization, you are entitled to gratuity. However, one thing to keep in mind here is continuity. If you have taken a long leave without pay or had a significant gap during this one year, it may affect your eligibility. Therefore, continuity of service is the key to this new rule.

How is gratuity determined?
The government has established a standard formula for gratuity calculation, which is very easy to understand. People often make the mistake of calculating gratuity based on their in-hand salary or CTC, whereas gratuity is always calculated based on their basic salary and dearness allowance (DA).

Formula: (Last Basic Salary + DA) × (15/26) × (Total Years of Service)

Two numbers in this formula are very important: 15 and 26.

15 – Because you are rewarded with 15 days' salary for each year.

26 – There are an average of 30 days in a month, but 4 Sundays are excluded. Therefore, 26 working days are considered.

How much money will you get on a salary of Rs. 30,000?
Suppose you work for a company and your last basic salary was Rs. 30,000. Under the new rules, you have completed one year there. Now let's see how much money you will get in your pocket.

Last Basic Salary: ₹30,000
Years of Service: 1
Calculation: 30,000 × (15/26) × 1
This amount will come to around ₹17,307 (approximately ₹17,300). This simply means that employees who previously worked for 4 years and 11 months and still ended up empty-handed will now be able to take home a substantial sum after just one year.
