Gratuity Rules India 2026: If you are planning to change jobs in 2026, there's one more thing you should check besides your salary: gratuity. Many people overlook gratuity when changing jobs, even though, under the new rules, many employees are now eligible for gratuity benefits after just one year of service. This is especially good news for those working on contract and fixed-term agreements.

What is Gratuity?
Gratuity is a sum of money that a company pays to its employee in return for their service. This money is given to the employee for their continuous hard work and dedication when they leave the job or their contract ends.

Gratuity Available After Just One Year
Now, under the new Social Security Code, employees working on fixed-term and contract agreements can receive gratuity after just one year of service. Previously, five years of service were required. However, the five-year rule still applies to permanent employees.

What are the conditions for receiving gratuity after one year?
The benefit of one year's gratuity will only be available if the employee has worked continuously for a full year. A long break or excessive leave during this period may affect eligibility. If the employee leaves the job, the gratuity is calculated from the joining date to the last working day.

A Big Relief for Job Changers
This rule is very beneficial for those who frequently change jobs or work on a short-term and contract basis. Now, they will also receive financial security even with short-term employment.

How much gratuity on a basic salary of ₹45,000?
If your basic salary is ₹45,000 and you have worked for one year, you can receive approximately ₹25,962 in gratuity. This shows that even those working for a short period are now directly benefiting.

How much money will you get on a basic salary of ₹75,000? If your basic salary is ₹75,000 and you have completed one year of service, your gratuity amount could be approximately ₹43,269. This amount can provide significant financial support when you change jobs.

How is Gratuity Calculated?
The formula for calculating gratuity is very simple. The last basic salary is multiplied by the number of years of service, then multiplied by 15 and divided by 26. According to the new labor code, there are considered to be 26 working days in a month. This does not include weekly holidays. Therefore, gratuity is calculated based on 26 days.

Simple formula for calculating gratuity: (Last Basic Salary + DA) x (Years of Service) x 15 / 26
Using this formula, any employee can calculate their own gratuity.

Benefit even after working for 11 months
One major advantage of gratuity is that if an employee has worked for slightly less than a year, i.e., more than 11 months, it can still be considered a full year of service, and they can receive gratuity.

Gratuity is Tax-Free
Gratuity is completely tax-free. This is the biggest relief for employees changing jobs, as no tax is levied on this amount.

Understand your salary and gratuity calculations before changing jobs
If you are planning to change jobs in 2026, be sure to calculate your basic salary, years of service, and gratuity. A little information can bring you significant benefits.
