Excessive Demolition: Victim to Receive ₹10 Lakh Compensation; Court Stern on Bulldozer Action

The Calcutta High Court has ordered officials to reconstruct two buildings, provide free alternative housing, and pay ₹10 lakh in compensation following excessive demolition carried out during an encroachment removal drive in Purba Medinipur.

In West Bengal's Purba Medinipur district, the local municipal body demolished several illegally constructed buildings using bulldozers. The Calcutta High Court has now issued a significant directive regarding this action. It was alleged that the municipality demolished parts of several homes beyond the permissible limits. This matter subsequently reached the High Court.

The incident dates back to 2024. Government officials had initiated a survey across the district regarding the boundaries of government land, leading to a decision to demolish two buildings. The petitioners claimed that the demolition work exceeded the prescribed scope and resulted in the destruction of their property.

What did the Court say during the hearing?

The case was heard by Justice Partha Sarathi Sen. While the State argued that there was no evidence to suggest the action had exceeded the prescribed limits, the Court delivered its order after carefully examining all documents and available records. The Court concluded that the government officials had failed to adhere to the prescribed limits during the demolition and had caused significant damage to the petitioners' property while removing encroachments. The Court termed the action a violation of legal rights.

New buildings must be reconstructed within two years

Holding the government officials accountable, the Court ordered the reconstruction of the buildings. According to the order, the construction must be completed within two years. Additionally, the officials must pay ₹10 lakh in compensation to the affected families. This amount is to be paid in two installments: the first ₹5 lakh by October 2026, and the remaining ₹5 lakh by February 2027.
