Significant discontent has emerged among pensioners regarding the Eighth Pay Commission. The Central Government Pensioners Welfare Association (CGPWA) in Jammu has alleged that the Terms of Reference (ToR) of the 8th Pay Commission do not formally include existing pensioners and family pensioners.

The CGPWA, Jammu, has written to Prime Minister Narendra Modi expressing deep concern over this issue. The organization's president, Kuldeep Khoda, stated that copies of this representation have also been sent to the Union Finance Minister, the Minister of State for Pensions, and the Chairperson of the 8th Pay Commission.

CGPWA President Levels Serious Allegations
Kuldeep Khoda stated that although government ministers have repeatedly assured the public that the interests of pensioners will be taken care of, these assurances are not reflected in the notified ToR of the 8th Pay Commission. He said that when the issue of pensioners being excluded from the scope of the ToR arose, the Finance Minister and other ministers clarified that the commission would look into pension-related matters, but this is not clearly stated in the document.

'Lack of Clear Mention in ToR is a Cause for Concern'
He also referred to the clarification given by the Ministry of Finance in the Rajya Sabha on December 2, 2025, which stated that pensions have not been excluded from the purview of the 8th Pay Commission. Despite this, the lack of explicit mention of pensioners in the ToR notified on November 3, 2025, remains a cause for concern for pensioners.

Objection Raised to Amendments in Rules
Khoda, a former DGP, also objected to the amendments made to the Central Civil Services (Pension) Rules through the Finance Bill 2025. He stated that these changes have retrospectively validated the differential treatment of pensioners based on their date of retirement. He alleged that this undermines previous court judgments and assurances given in Parliament. The CGPWA has also objected to terms used in the Terms of Reference (ToR), such as "unfunded cost of the non-contributory pension scheme." The organization states that the Supreme Court has already clarified that a pension is not a matter of charity but a deferred wage and a property right, and that all pensioners belong to the same class.

Condition for restoration of commuted pension after 15 years
Furthermore, the organization has demanded the implementation of the parliamentary committee's recommendations on additional pension for senior citizens and a review of the conditions for restoring commuted pension after 15 years. The CGPWA has clearly stated that current and family pensioners should be explicitly included in the ToR of the 8th Pay Commission.
