Government Compensation from the Railways
Under Section 124A of the Railways Act, 1989, financial assistance is provided to the family in the event of death resulting from a train accident or an untoward incident—such as a terrorist attack, dacoity, riot, or accidentally falling from a moving train. In such cases, the Railway Claims Tribunal awards statutory compensation of ₹8 lakh to the victim's family. Typically, immediately following major accidents, the Railways provide an *ex-gratia* payment of up to ₹50,000 in cash to meet the family's immediate needs; however, in cases of severe accidents, the government may increase this amount to up to ₹10 lakh.
IRCTC Travel Insurance Compensation
If you opted for the optional travel insurance—costing merely 35 to 45 paise—while booking your ticket online via the IRCTC website (https://www.irctc.co.in/) or app, a separate claim can be made through the insurance company. In the event of the death of an insured passenger in a train accident, an additional insurance claim of ₹10 lakh is paid to their nominee or legal heir. Thus, by combining the primary compensation of ₹8 lakh from the Railways with the ₹10 lakh claim from the IRCTC travel insurance, the passengers' families can receive a total of ₹18 lakh. According to Section 124A of the Railways Act, the Railways does not provide compensation for deaths occurring in the following ways:
Suicide or attempted suicide by the passenger; accidents resulting from self-inflicted injury or while illegally crossing railway tracks; natural deaths or deaths caused by pre-existing medical conditions (such as a sudden heart attack while on the train); and accidents caused by extreme intoxication or gross negligence on the part of the passenger.
Compensation is available even if the ticket is lost.
In cases involving missing or lost tickets, a landmark Supreme Court ruling established that if a valid passenger's ticket is lost or dropped during an accident, the claim for compensation cannot be rejected solely on the grounds of the ticket being missing; compensation must be awarded based on the circumstances. According to this ruling, the Railways' liability extends beyond just the time spent on the moving train; it applies to the entire process, starting from entering the station premises until disembarking from the train.
How to claim compensation?
Immediately after the accident, visit the GRP (Government Railway Police) station to lodge a complaint and obtain a copy of the FIR.
Keep the deceased's identity proof, train ticket or PNR number, GRP *panchnama* (police inquest report), post-mortem report, and death certificate safe.

How to claim ₹10 lakh through e-ticket insurance
By opting for travel insurance costing merely 35–45 paise when booking an IRCTC e-ticket, the nominee becomes eligible for a claim of ₹10 lakh in the event of death due to a train accident. If you opted for travel insurance while booking an e-ticket via the Indian Railways (IRCTC) website or mobile app, the nominee or legal heir is entitled to an insurance claim of up to ₹10 lakh in the event of the passenger's death due to an untoward incident or accident. It is important to note that to receive the claim, one must directly contact the relevant insurance company and submit the necessary documents within four months (120 days) of the accident.
How to identify your insurance company?
After the ticket is booked, IRCTC sends the policy certificate to the passenger's registered email ID and mobile number.
