The Department of Telecommunications (DoT) on Monday issued strict guidelines regarding tampering with the IMEI and other telecom identifiers of mobile phones. The department warned mobile phone manufacturers, brand owners, importers, and sellers that altering the IMEI will be considered a serious offense under the new law.

According to the DoT advisory, tampering with the telecom identifier, or 15-digit IMEI number, can result in a jail term of up to three years, a fine of up to ₹50 lakh, or both. It is also a non-bailable and cognizable offense. The department stated that this provision applies under the Telecommunications Act, 2023, and the Telecom Cyber Security Rules, 2024, which prescribe very stringent penalties for such offenses.
IMEI tampering makes it difficult to catch criminals.
The DoT stated that any alteration of the IMEI poses a significant challenge for law enforcement agencies. Tampered devices confuse tracking systems, making it difficult to reach criminals. This is why the government is extremely strict about IMEI registration and security.
Holding illegal or tampered devices is also a crime
According to telecom laws, not only changing the IMEI but also knowingly using, purchasing, possessing, or having custody of any such device is a crime.
Possession of a mobile phone, modem, SIM box, or any radio device that has been modified can also be grounds for punishment.
Phones with programmable IMEIs are also covered by the law
DoT clarified that phones with programmable IMEIs, whose IMEI numbers can be changed, also fall under the category of tampering under the law. Those who manufacture, purchase, import, sell, or use such devices will be subject to the same penalties as those for changing the IMEI.
