During the hearing, California Deputy Attorney General Megan O’Neill leveled several serious accusations against Meta before the jury. She stated that the company was aware of the impact certain features on Instagram and Facebook had on children's mental health but failed to take necessary action.
O’Neill asserted that the responsibility for children's safety does not rest solely with parents; social media companies also play a significant role. According to her, Meta was cognizant of the risks but prioritized its profits over the safety of children.

Lawyers for the states say that internal Meta documents and emails will be presented during the hearing. These documents reveal the company's mindset regarding teenage users.
One document stated, "the young ones are the best ones." Another noted that teenagers remained attached to Instagram even when it did not make them feel good, and that the platform could be addictive.
The states' lawyers allege that Meta was aware of these issues but prioritized its business interests and revenue.
Allegations regarding the collection of children's data
A 233-page complaint filed in 2023 contains another serious allegation against Meta. The states claim the company collected data on children under the age of 13 without parental consent. It is alleged that this practice violates several federal and state laws. The states allege that Meta refrained from removing or modifying features deemed harmful to children, despite being aware of the risks. Meta could face fines of up to $200 billion in this matter.

However, Meta has denied all the allegations. Paul Schmidt, the company's lawyer, stated in court that the lawyers representing the states are selectively presenting information from internal documents and emails.
He argues that these documents should be viewed in their full context. Meta maintains that the material presented by the states has been taken out of its original context.
If the states' allegations are proven in court, the consequences will extend beyond the imposition of massive fines on Meta; the company might also be compelled to make significant changes to certain features on Instagram and Facebook designed for children and teenagers.
