This is excellent news for candidates holding a Special B.Ed. Degree. The Delhi High Court has clearly stated that candidates with a Bachelor of Education (B.Ed.) degree in special education are eligible for Trained Graduate Teacher (TGT) and Post Graduate Teacher (PGT) posts in general subjects. The court emphasized that if the recruitment advertisement did not explicitly exclude their qualification, candidates cannot be disqualified at a later stage.
This judgment was delivered by a bench of Justices Navin Chawla and Saurabh Banerjee, which dismissed petitions filed by the Delhi government and the Delhi Subordinate Services Selection Board (DSSSB). The petitioners had challenged the orders of the Central Administrative Tribunal (CAT), which had earlier deemed such candidates ineligible.
What did the court decide?
The bench examined the relevant recruitment advertisements. It found that the notifications stipulated the requirement of a “degree/diploma in teaching,” but nowhere was a B.Ed. (Special Education) degree declared as a disqualifying qualification. The court ruled that since there was no explicit restriction in the advertisement, it was unacceptable to disqualify candidates holding this degree at a later stage.
While the petitioners argued that B.Ed. (General) and B.Ed. (Special Education) There are different qualifications; the bench referred to a crucial affidavit submitted by the Rehabilitation Council of India (RCI), the statutory body regulating special education training. The RCI confirmed that B.Ed. (Special Education) Degree holders are fully capable of teaching general students in mainstream schools, as their training includes all the essentials of a general B.Ed. Program along with additional specialized training.
