The rule is currently under proposal and is expected to be published by January 2026. The proposed rule could change the Green Card requirements for foreign workers with exceptional abilities, professors, and researchers with outstanding qualifications.
What does the government want to change?
According to a DHS summary, the proposed rule will update and modernize provisions for workers with exceptional abilities and highly qualified professors and researchers. It will also clarify the requirements for First Preference Classification, National Interest Waiver Classification (NIW), and nationally and internationally renowned physicians.
This means the government plans to redefine the eligibility and documentation standards foreign workers must meet for employment-based permanent residency. Simply put, while certain categories of workers previously had easy access to green cards, they will now have to submit more documentation and evidence to obtain them under the new rules.
Which workers will be affected by the new rule?
According to USCIS, O-1A visas are granted to individuals with exceptional abilities in fields such as science, education, business, or athletics to work in the United States. The best part of this visa is that it doesn't require job sponsorship from any company. Those who receive this visa can easily obtain a green card without a long wait.
Similarly, individuals who come to work for the benefit of the United States are allowed to enter the country under the National Interest Waiver (NIW). The government also readily grants these individuals green cards. Professors, teachers, researchers, businessmen, athletes, and scientists are among the most from both these schemes.
