A petitioner in the Supreme Court, while describing himself as unable to write, had said in his petition that he is suffering from a chronic neurological condition. His permanent disability is 25 percent. The petitioner alleged that he was denied the facility of a scribe or assistant by IBPS, SBI, SSC, and the Department of Empowerment of Persons with Disabilities of the Government of India on the grounds that his disability was less than 40 percent. The petitioner said that even after the court's decision in the Vikas Kumar case, the examination authority refused to provide an assistant citing benchmark disability.

Justice J.B. in the Supreme Court. The bench headed by Pardiwala said that earlier under the UPSC rules, only those candidates who had more than 40 percent disability like blindness, cerebral palsy, etc. were given the facility of scribe or assistant. During its hearing, the court ordered that now this facility will also be available to those candidates whose writing ability is affected, even if their disability is less than 40 percent. The court also directed the nodal agency Ministry of Social Justice and Empowerment to implement the amendment within two months. Along with this, the Supreme Court also asked the examination bodies conducting IBPS, SBI, SSC, and UPSC exams to follow the guidelines.
