NMC scraps medical rulebook; will colleges go unpunished for breaking rules?
NMC Medical Rule Book: Medical colleges in the country no longer have the rule book that specified the penalties to be imposed in the event of irregularities. The National Medical Commission (NMC) has withdrawn the 'Maintenance of Standards of Medical Education Regulations 2023' with immediate effect. Consequently, the prescribed fines, provisions for seat reductions, and individual penalties for doctors who submit incorrect records have also been abolished.
However, a key component of the MSMER 2023—the 'Annual Disclosure Report' (ADR), which every medical institution is required to submit—will remain in effect as before.
What were the rules in the rule book?
The 'Maintenance of Standards of Medical Education' served as an enforcement manual for the NMC. It outlined the penalties that colleges would face if they failed to meet minimum standards, provided false information regarding their facilities, or acted in a manner contrary to the objectives of medical education. It also detailed the procedure for colleges to appeal against any penalties they deemed unjust.
Rules implemented in 2023
The National Medical Commission (NMC) is the statutory body that regulates medical education and the medical profession in the country. It notified the 'Maintenance of Standards of Medical Education' regulations in September 2023, with the objective of ensuring that institutions involved in medical education uphold the necessary standards and systems.
The NMC has now formally withdrawn these regulations. This decision has been taken by exercising the powers granted under the National Medical Commission Act, 2019.
What will be the impact on medical colleges?
A notification issued by the National Medical Commission explicitly states that any decisions taken or orders issued based on actions initiated while the 2023 regulations were in effect will not cease to be valid simply because those regulations have been withdrawn. Similarly, any previously granted approvals, renewals, orders, and directions will remain unaffected.
