The Supreme Court has abolished the domicile reservation given under the seats for post-graduation medical courses within the state quota. The Supreme Court has canceled the domicile reservation calling it a violation of Article 14 of the Constitution. In such a situation, now the students will not be able to use this reservation for admission.
The Supreme Court bench gave this order.
A bench of Justice Hrishikesh Roy, Justice Sudhanshu Dhulia, and Justice SVN Bhatti said that as citizens and residents of India "we have the right to choose residence anywhere, the Constitution also gives us the right to choose admission in educational institutions across India." The bench further said in its statement "We are all residents of India. There is no such thing as a resident of a state or state, we have only one place of residence and that is the country. We are all residents of India. We have the right to choose and follow residence anywhere in India. The court said that anyone can pursue their profession/business anywhere.
Exemption for special states
The court said in its decision that "for those living in a particular state" this can be considered. But this will apply only to graduation courses. It will not apply to post-graduation courses. The court said that "given the importance of specialist doctors, reservation based on residence at higher levels would violate Article 14."
Quota should be allocated to states only based on merit
This order given by the Supreme Court ensures that admission to PG medical courses is only based on merit i.e. on the score of NEET / National Eligibility / Entrance Test and not based on native quota being given in the states.
This order of the Supreme Court will be applicable only to the future admission process. This order will not be applicable to students who have been admission under this reservation and are completing their studies or have completed their studies.
