The Court clarified that an MBBS student is allowed a maximum of four years—or four attempts—to pass the first year. The Court further clarified that this limit of four attempts is entirely independent of which subject was taken or skipped during any specific attempt.

The student argued in court that she had taken the 'Anatomy' paper only three times. Therefore, she contended that, according to the rules, she should be granted a fourth opportunity to clear the subject. The court stated that the rules apply equally to everyone and that, under no circumstances, can a fifth attempt be granted after the four permitted attempts are exhausted.
